Privacy Policy

Parties:
“We”; “Our” – refers to GoodLister (Pty) Ltd (“GoodLister”), a registered company. 
“You”; “Your” – refers to you, the registered User of the GoodLister™ app. 

Terms:
“the App” – refers to the GoodLister™ smartphone app developed by GoodLister and used to provide its services to its User.

“the User” – refers to any person who has created a user account on the App and makes use of the App. 

“Personal Information” – refers to the information provided by the User.

“Device Information” – refers to the set of device attributes and characteristics that are designed to identify a particular device.

“Other Information” – refers to information that does not fall under the definition of Personal Information or Device Information.

This Privacy Policy (“Policy”) applies to all Users and describes how your Personal Information, Device Information and Other Information (collectively “your Information”) is collected, used, and shared when you create an account on, make use of, and/or make a purchase on the App. 

The purpose of this Policy is to set out how, when and why GoodLister collects, retains and uses your Information in order to comply with the Protection of Personal Information Act, 4 of 2012 (“POPIA”).

It is important that all Users read this Policy together with our Terms and Conditions (“Ts & Cs”) found here and clearly understand and agree to the terms therein.

GoodLister respects its Users’ privacy and takes the protection of their Information very seriously.

By making use of the App, you agree to and consent to GoodLister collecting, retaining and processing your Information as set out in this Policy.

 

PERSONAL INFORMATION WE MAY COLLECT 
When you create an account on the App, we may collect and process certain information from you such as, but not limited to, your:

  • Name;
  • Surname;
  • Phone number;
  • Email address;
  • Gender;
  • Age;
  • Physical address;
  • Certain payment information; and/or
  • Online identifiers.

Providing us with this information is voluntary but necessary for us to provide you with our services and access to the App.

GoodLister does not collect and retain any of its Users’ payment information. All payments made for Subscriptions on the GoodLister App are processed by:

  • Apple if the User is making use of an Apple Device; and
  • Google if the User is making use of an Android device.

The two above mentioned entities are independent from us, which means we do not have direct access to your payment information.

Should your Personal Information change or should you wish to amend same, you can do so by updating your user information in your account profile.

You warrant that all the Personal Information that you provide us with is accurate, up to date, true and correct and does not impersonate any other third party or entity.

When you create an account on the App, we may collect and process information necessary for your account to be registered, such as the necessary information used for registration and login purposes from Facebook, Google or other similar services.

DEVICE INFORMATION WE MAY COLLECT

We automatically collect certain information about your device, including information about your:

  • IP address;
  • Time zone;
  • Device used to access and use the App;
  • Geographic location; and/or
  • Some of the cookies that are installed on your device.

Additionally, as you make use of the App, we may collect certain information about how you interact with the App, allowing us to curate a better User experience. 

OTHER INFORMATION WE MAY COLLECT

When you use the App, we may collect the following information, but not limited to:

  • How, when and for how long you make use of the App;
  • The features you interact with the most; and/or
  • The content in your list(s).

There may be instances where we receive information about our Users from third parties. This may occur if the App is ever integrated with other services or platforms that you already use.

Additionally, when you contact us we may collect and process your name, email address, phone number and/or other information you provide us with during the correspondence.

Providing us with this information is voluntary but necessary for us to provide you with answers to your questions.

HOW & WHY WE PROCESS YOUR INFORMATION
We use the Information you provide us with to:

  • Identify you as a User;
  • Verify your identity;
  • Create an account for you;
  • Confirm payment(s) of Pro Subscriptions offered on the App;
  • Communicate with you; 
  • Provide you with information or advertising relating to our services (unless you have specifically opted out of receiving such information);
  • Get feedback from you in order to improve and optimise the App;
  • Send you information about competitions or services that may interest you (unless you have specifically opted out of receiving such information);
  • Notify you of changes made to the App;
  • Comply with legal or regulatory obligations; and/or
  • Carry out necessary research.

SHARING YOUR INFORMATION 
We confirm that we will not share or sell any of your Personal Information with any third parties for marketing purposes.

We may however, share your Information in order to:

  • comply with any applicable laws and regulations;
  • respond to any subpoenas, search warrants or other lawful requests for information we may receive; and/or
  • otherwise protect our rights. 

We will share your Information with government officials, law enforcement and/or fraud detection agencies if and when necessary.

We will share certain information with third parties, such as, but not limited to:

  • the number of users on the App;
  • certain trends that Users are displaying; and/or
  • other similar analytics that will help us improve the overall user experience of the App.

We will share your Information with our employees.

We will be able to anonymise your Information (which will then cease to be ‘Personal Information’) in order to present aggregated business or statistics information about processes and/or issues related to the App’s functionalities.

BEHAVIOURAL ADVERTISING 
As described above, we use your Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.

OPT OUT OF DIRECT MARKETING

At any point you have the option to opt out of GoodLister direct marketing.

Users can opt out of direct marketing by unsubscribing to our mailing list on any direct email received from GoodLister.

DATA RETENTION 
We will retain your Information for as long as you have an active GoodLister account.  

If a User chooses to permanently delete their account, then all of their Personal Information will be deleted accordingly and removed from our database.

CHANGES 
We may update this Policy from time to time in order to reflect, for example, but not limited to, changes to our practices or for other operational, legal or regulatory reasons. 

It is your duty, as a User, to regularly check this Policy and make yourself aware of any changes made. You will not be notified if and when changes are made.

MINORS 
The App caters to Users of all ages to create, share and edit lists with their friends, family, and colleagues.

Should you be under the age of 18 (eighteen) and want to use the App and subsequently provide us with your Information, then you must first obtain consent from your parent(s) or legal guardian(s) to do so.

By creating an account on the App and providing us with your Information, you warrant that you are either 18 (eighteen) years or older and of full capacity, or have obtained consent from your parent(s) or legal guardian(s), or are under the supervision of your parent(s) or legal guardian(s).

YOUR RIGHTS

As a registered User of the App, you have the right to:

  • View, amend and/or correct your Personal Information that you have provided us with (this can be done on the App in your account profile);
  • Request a record of your Personal Information (GoodLister reserves the right to charge Users in order to provide them with this information);
  • Have your Personal information deleted; and
  • Be notified of any unauthorised access to your Personal Information.

SECURING YOUR INFORMATION

All the necessary procedures are taken to secure the confidentiality and integrity of the Information that you provide us with.

Our database is stored on and maintained by Google Cloud. Google is independent from us which means that all your Information is protected in accordance with Google’s protocols.

ENTRUSTMENT OF PROCESSING SHARING AND/OR TRANSFER OF INFORMATION

IT system providers, technology service providers, email operators and hosting companies may gain access to your Information.

When you contact us via email, IT system providers and email operators may gain access to your Information.

When you purchase a Subscription, Apple or Google – the relevant payment operator – will gain access to your Personal Information.

When you create an account on the App, your information will be stored safely on the Google Cloud servers.

All the service providers we make use of are highly reputable – such as, most notably, Apple and Google.
